CPS LEGAL PERMISSIONS

The Coalition for Plasma Science (CPS) Website supports CPS's efforts to educate people outside the field about plasmas. Educators and others are encouraged to use the CPS Materials properly in order to educate people, including themselves, about plasmas. The Materials are NOT to be used in connection with commercial enterprise.

The Materials (as defined below) are protected by copyright and/or other applicable law. Any use of the Materials other than as authorized under this license is prohibited.

By exercising any of the rights to any portion of the Materials provided here, You (as defined below) accept and agree to be bound by the terms of this license. The Licensor, the Coalition for Plasma Science, grants You the rights contained here in consideration of Your acceptance of such terms and conditions.

1. Fair Use Rights and Third-Party Rights.

Nothing in this license is intended to reduce, limit, or restrict any rights arising from fair use, first sale or other limitations on the exclusive rights of the copyright owner under copyright law or other applicable laws. Nothing in this license is intended to reduce, limit, or restrict any rights owned by third-parties.

2. License Grant

This overall Website is Copyrighted by CPS. All rights are reserved by CPS except as explicitly granted in this license.

Portions of the Materials include figures, graphs, or photos that must remain with their accompanying text because these portions have been licensed from others outside CPS. The figures, graphs, or photos, together with their accompanying text, are hereinafter referred to as Units. Individual Units will be identified on the CPS Website. Permission and/or information about the owner of these Units can be obtained from CPS, but copying, distributing, or displaying any portion of such Units, but not the entire Unit as a whole, is prohibited without the consent of CPS and/or the licensor of such Units. Units must remain unabridged and unmodified.

Except for limited portions in the public domain, the Materials are copyrighted and are the exclusive property of CPS or its respective licensors. This Agreement conveys a limited right to use the Materials and shall not be construed to convey title in any of the Materials to You. CPS reserves the right to add, remove, or otherwise modify the content of the CPS Website at any time without notice to You.

All of the Materials on this Website may be copied, but there are some limitations to the copying, distribution, and display of any such Materials, even if done solely for educational purposes.

CPS permits You to copy, distribute, and display all or any part of the Materials for educational purposes and not for a fee so long as Units remain unabridged and unmodified. In return, You must maintain CPS's copyright notices and attributions in the content and, if copied to a website, link the content back to this Legal Permissions page. You may not use the Materials for commercial purposes, unless You get CPS's prior written permission. IN NO EVENT SHALL CPS, ITS OFFICERS, MEMBERS OR AFFILIATES BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ECONOMIC DAMAGES OR INJURY TO PROPERTY, PERSON OR LOST PROFITS, REGARDLESS OF WHETHER CPS SHALL BE ADVISED, SHALL HAVE OTHER REASON TO KNOW OR IN FACT SHALL KNOW OF THE POSSIBILITY OF THE FOREGOING.

4. Miscellaneous

    If any provision of this License is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this License, and without further action by the parties to this agreement, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

    This License constitutes the entire agreement between the parties with respect to the Materials licensed here. There are no understandings, agreements or representations with respect to Materials not specified here. CPS shall not be bound by any additional provisions that may appear in any communication from You. This License may not be modified without the mutual written agreement of CPS and You. 

5. Definitions

    "Collective Work" is a work, such as a periodical issue, anthology, or encyclopedia, in which a number of contributions, constituting separate and independent works in themselves, are assembled into a collective whole.

    "Derivative Work" is a work based upon one or more preexisting works, such as a translation, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a ''derivative work''.

    "Original Author" means the person or persons who originates or creates any portion of the Materials.

    "Materials" mean any or all copyrightable works of authorship that are available on the Website and its family of sites [http://www.plasmacoalition.org] which are offered under the terms of this License, except as noted above.

    "Unit" means any specially identified figures, graphs, or photos combined with accompanying text. Units can be found in a variety of formats, including but not limited to: two-page publications, brochures, or posters.

    "You" means an individual or entity exercising rights under this License who has not previously violated the terms of this License with respect to the Materials, or who has received express permission from CPS to exercise rights under this License despite a previous violation. 

Infringement Notification

CPS, prior to making any CPS Materials publicly available, has reviewed all Materials extensively to determine the correct ownership of the Materials and obtain the appropriate licenses to make the Materials available on the CPS Website. CPS will promptly remove any Materials that are determined to be infringing on the rights of others. If you believe that a portion of the Materials infringe another's copyright, please send us feedback. If you do not include an electronic signature with your claim, you may be asked to send or fax a follow-up copy with a signature. To file the notification, you must be either the copyright owner of the work or an individual authorized to act on behalf of the copyright owner. Your notification must include:

1. Identification of the copyrighted work, or, in the case of multiple works at the same location, a representative list of such works at that site.

2. Identification of the Materials that are claimed to be infringing or to be the subject of infringing activity. You must include sufficient information, such as a specific URL or other specific identification, for us to locate the Materials.

3. Information for us to be able to contact the claimant (e.g., email address, phone number).

4. A statement that the claimant believes that the use of the Materials has not been authorized by the copyright owner or an authorized agent.
